SQUAREFRAME LLC - PRIVACY POLICY

For purposes of this Privacy Policy, "Squareframe", “we”, “us”, or “our” refers to Squareframe LLC and any successors to the assets or business of Squareframe LLC. A "customer" is any person who uses or engages with Squareframe via our mobile application (“app”), or website located at www.sqframe.com.

Below is our Policy regarding the collection, use, and disclosure of your information. Our goal by collecting this information is to provide you with the most personalized, user-friendly experience possible. In order to make sure you are up-to-date on any changes to this Policy and our use of your information, please check this page from time to time. SECTION 2 – CUSTOMER INFORMATION

Customer information is defined as identifiable information regarding our customers, including but not limited to, names, addresses, email addresses, billing information, and social media information. When you interact with our app or website, we collect this information. As mentioned above, our goal by collecting this information is to provide you with a more personalized, user-friendly experience and transaction. Collecting this information helps us to improve our app and/or website, thereby further improving your experience. For example, we may use your customer information to complete purchase transactions, fulfill order requests, and/or communicate with you for a variety of purposes. Please be aware that any information you submit to third parties is subject to the policies of those parties.

SECTION 3 – OTHER INFORMATION

When you interact with our app or website, we may also collect other information, including but not limited to, your browser type, internet service provider, date/time stamp, mobile device operating system, unique device identifier, and mobile network information. We analyze and use this information to analyze the demographics of our users to better tailor our app or website to your needs and preferences. We may also use cookies to collect information. Cookies are small files placed on your computer’s hard drive that enable website servers to recognize or remember you next time you visit their website. You have a choice with respect to cookies. SECTION 4 - CONSENT

By using our app or website, you consent to the collection, use, and disclosure of your customer information and other information in accordance with this Policy. For example, when you provide us, including our third-party providers, with customer information to complete a transaction, we imply that you consent to the collection and use of it for that purpose. We also imply that you accept receiving communication from us to complete the transaction, request feedback, and/or inform you of app or website improvements, product announcements, promotional offers, or other marketing efforts that may be of interest to you.

If you wish to withdraw your consent for us to contact you, or for the continued collection, use, or disclosure of your information, please contact us by email at info@sqframe.com. We may retain customer information needed for maintaining business records of cancelled accounts or in accordance with applicable law.

SECTION 5 – AGE OF CONSENT

Our app or website is not directed to children and children are not eligible to use our app or website. By using our app or website, you represent that you are at least the age of majority in your state or province of residence, or under 13 years of age. If and when our app or website does collect age information, and users identify themselves as under 13, we will take steps to remove that user's information from our databases and to prevent the user from utilizing our app.

SECTION 6 - THIRD-PARTY PROVIDERS

In general, the third-party providers utilized by our app or website will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, many third-party providers, such as payment gateways and other payment transaction processors, have their own privacy policies in place to collect, use, and disclose your information. Through our app or website, we may allow you to connect with third party photo providers such as Instagram. If so, we will work with such providers’ application protocol interfaces, otherwise known as API, to access your provider account on your behalf. You will not be required to provide us with your username or password for that provider. However, you will be required to log in to that provider through our app and once authorized by you, the provider will provide us a token that allows us to access, on your behalf, your provider account information. By proceeding, we imply that you grant us access to your information and that you agree to such provider’s terms of use. Any information that we collect from a provider account may depend on your privacy settings with that provider, so please be aware of such provider’s privacy policies and data practices. If you wish to revoke our access to your provider account information, you may log out of our access to your provider account through our app or website, or modify the settings from within your provider account settings.

SECTION 7 - DISCLOSURE

If you choose to provide us with your customer information, Squareframe may transfer that information to affiliates, partners, or other third parties. If Squareframe is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you. Further, we reserve the right to disclose your information if we believe in good faith that such disclosure is necessary, including but not limited to, to abide by law, to protect or defend our rights or property or the rights of other users of our app or website, or if you violate our Terms of Service.

SECTION 8 - SECURITY

To protect your information, we follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

SECTION 9 – LAW AND ARBITRATION

This Privacy Policy is governed by and construed in accordance with the laws of the State of Georgia, in the United States, exclusive of its choice of law rules. Further, except where prohibited, you agree that: (1) any and all disputes, claims and causes of action arising out of your use of this Privacy Policy will be resolved individually, without resort to any form of class action, and shall be submitted to the alternative dispute resolution service for binding arbitration under its rules then in effect in the State of Georgia and determined by one (1) arbitrator to be mutually agreed upon by both parties, with the parties agreeing to share equally in the arbitration costs; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with use of the Squareframe app, website and/or services, but in no event attorneys' fees; and (3) under no circumstances will you be permitted to obtain awards for, and, by using the Squareframe app, website and/or services, you waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Please note that this arbitration provision shall survive the termination of your relationship with us. If, for any reason, this arbitration provision is not upheld, the exclusive forum and venue to resolve any disputes arising out of or otherwise relating to this Privacy Policy or our app, website or services will be in the state and federal courts of Georgia.

SECTION 10 – OTHER COUNTRIES

Your information may be processed by us in the country where it was collected as well as other countries (including the United States) where laws regarding processing your information may be less stringent than the laws in your country. By using our app or website, and providing your information, you are consenting to the transfer of data from your country to a country that has less stringent laws, and the processing of your information in conformance with this Policy.

SECTION 11 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on our app or website. If we make material changes to this Policy, we will notify you via the last email address you have provided to us, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use or disclose it. Continued use of our app or website after notice of changes will indicate your acknowledgement of these changes and agreement to be bound by the terms and conditions of these changes.
